John Locke: Two Treatises of Government

§ 232. Whosoever uses force without right, as everyone does in society, who does it without law, puts himself into a state of war with those against whom he so uses it; and in that state all former ties are cancelled, all other rights cease and everyone has a right to defend himself and to resist the aggressor. This is so evident, that Barclay72 himself, that great assertor of the power and sacredness of Kings, is forced to confess: That it is lawful for the people in some cases, to resist their King; and that too in a chapter, wherein he pretends to show, that the divine law shuts up the people from all manner of rebellion. Whereby it is evident even by his own doctrine, that since they may in some cases resist all resisting of Princes is not rebellion. His words are these:

Quod siquis dicat, Ergone populus tyrannicae, crudelitati et furori jugulum semper praehibit? Ergone multitudo civitates suas fame, ferro et flamma vastari, seque, conjuges et liberos fortunae ludibrio et tyranni libidine exponi, inque omnia vitae pericula omnesque miserias et molestias a rege deduci patientur? Num illis
quod omni animantium generi est a natura tributum, denegari debet, ut sc. vim vi repellant, seseque; ab injuria tueantur? Huic breviter responsum sit, Populo universo negari defensionem, quae juris naturalis est, neque ultionem quae praeter naturam est adversus regem concedi debere. Quapropter si rex non in
singulares tantum personas aliquot privatum odium exerceat, sed corpus etiam respublicae, cujus ipse caput est, i. e. totum populum, vel insignem aliquam ejus partem immani et intoleranda saevitia seu tyrannide devexet; populo quidem hoc casu resistendi ac tuendi se ab injuria potestas competit; sed tuendi se tantum, non enim in principem invadendi: et restituendae injuriae illatae, non recedendi a debita reverentia propter acceptam injuriam.

Praesentem denique impetum propulsandi non vim praeteritam ulciscendi jus habet. Horum enim alterum a natura est, ut vitam scilicet corpusque tuearmur. Alterum vero contra naturam, ut inferior de superiori supplicium sumat. Quod itaque populous malum, antequam factum sit, impedire potest, ne fiat, id postquam factum est, in regem authorem sceleris vindicare non potest: populus igitur hoc amplius quam privatus quisquam habet: quod huic vel ipsis adversariis judicibus, excepto Buchanano, nullum nisi in patientia remedium superest. Cum ille si intolerabilis tyrannus est (modicum enim ferre omnino debet) resistere cum reverentia possit.

§ 232. Wer physische Gewalt unrechtmäßig anwendet, wie es in der Gesellschaft jeder tut, der sie ohne gesetzliche Grundlage einsetzt, versetzt sich in einen Kriegszustand mit denen, gegen die er sie gebraucht. In dieser Lage werden alle früheren Bande gelöst, hören alle anderen Rechte auf und jeder Einzelne hat das Recht sich zu verteidigen und sich dem Angreifer zu widersetzen.

Dass ist derart evident, dass selbst Barclay72, der große Verfechter von Macht und der Heiligkeit der Könige sich genötigt sieht, einzugestehen: In manchen Fällen ist es der Bevölkerung erlaubt, einem König Widerstand entgegen zu setzen. Das geschieht sogar in einem Kapitel, in dem er nachzuweisen versucht, das göttliche Gesetz verbiete der Bevölkerung jegliche Rebellion. Daraus geht klar hervor, selbst nach seiner eigenen Lehre: Die Bevölkerung darf in manchen Fällen Widerstand leisten und nicht jeder Widerstand gegen Fürsten ist Rebellion. Seine Worte sind folgende:

John Locke: Two Treatises of Government

§ 135. Though the legislative, whether placed in one or more, whether it be always in being, or only by intervals, though it be the supreme power in every commonwealth; yet,

First: It is not, nor can possibly be absolutely arbitrary over the lives and fortunes of the people: For it being but the joint power of every member of the society given up to that person or assembly, which is legislator; it can be no more than those persons had in a state of nature before they entered into society, and gave up to the community: For nobody can transfer to another more power than he has in himself; and nobody has an absolute arbitrary power over himself, or over any other, to destroy his own life, or take away the life or property of another.

A man, as has been proved, cannot subject himself to the arbitrary power of another; and having in the state of nature no arbitrary power over the life, liberty, or possession of another, but only so much as the law of nature gave him for the preservation of himself, and the rest of mankind; this is all he doth, or can give up to the commonwealth, and by it to the legislative power, so that the legislative can have no more than this.

Their power, in the utmost bounds of it, is limited to the public good of the society. It is a power, that hath no other end but preservation, and therefore can never55 have a right to destroy, enslave, or designedly to impoverish the subjects. The obligations of the law of nature cease not in society, but only in many cases are drawn closer, and have by human laws known penalties annexed to them to enforce their observation.

Thus the law of nature stands as an eternal rule to all men, legislators as well as others. The rules that they make for other men’s actions, must, as well as their own and other men’s actions, be conformable to the law of nature, I. e. to the will of God, of which that is a declaration, and the fundamental law of nature being the preservation of mankind, no human sanction can be good, or valid against it.

§ 135. Die Legislative, befinde sie sich bei Einem oder Mehreren, oder bestehe sie permanent oder nur in Intervallen, ist zwar die höchste Macht in jedem Staat, doch:

Erstens handelt es sich um keine absolute, willkürliche Macht über Leben und Vermögen des Volks. Sie kann es auch niemals sein: Da sie nichts ist als die vereinte Macht aller Mitglieder der Gesellschaft, auf welche zugunsten der Person oder der Versammlung die der Gesetzgeber ist, verzichtet wurde, kann sie nicht größer sein als die Macht, die jede Person im Naturzustand hatte, bevor sie der Gesellschaft beitrat und die sie zu Gunsten der Gemeinschaft abgab.

Niemand kann einem anderen größere Macht überlassen, als er in sich selbst besitzt. Niemand hat eine absolute, willkürliche Macht über sich oder einen anderen, das eigene Leben zu vernichten oder Leben und Besitz eines anderen zu nehmen. Ein Mensch kann, was ich bewiesen habe, sich keiner willkürlichen Macht eines anderen unterwerfen. Da er im Naturzustand keine willkürliche Macht über das Leben, die Freiheit
oder den Besitz eines anderen hat, sondern nur so viel, als das Naturrecht ihm zum Erhalt seiner selbst und der übrigen Menschheit gewährt hat, ist das alles, was er zugunsten des Staats oder durch diesen zu Gunsten legislativer Macht abgibt oder abgeben kann.

Daher kann die Legislative nicht mehr haben als eben das. Ihre Macht in äußersten Grenzen ist auf das öffentliche Wohl der Gesellschaft beschränkt. Es ist eine Macht, die kein anderes Ziel als Erhalt hat. Sie kann deshalb nie55 ein Recht haben Angehörige zu zerstören, zu unterjochen oder mit Absicht auszusaugen.

Die Pflichten des Naturrechts hören bei in der Gesellschaft keinesfalls auf, sondern werden in vielen Fällen erst näher bestimmt und über menschliche Gesetze um anerkannte Strafen erweitert um ihre Beachtung zu verstärken. Das Naturrecht fungiert als ewige Grundordnung für alle Menschen, Gesetzgeber ebenso wie auch für die Anderen.

Vorschriften, die sie für Handlungen anderer Menschen erlassen, müssen ebenso wie eigene und anderer Menschen Handlungen mit dem Naturrecht, damit meine ich den Willen Gottes, dessen Verkündigung es ist, vereinbar sein. Da das grundlegende Naturgesetz im Erhalt der Menschheit besteht, kann kein menschliches Gesetz gut oder gültig sein, das diesem widerspricht.

55Zwei Grundlagen tragen öffentliche Gesellschaften. Die eine ist eine natürliche Neigung von Menschen nach einem geselligen Leben und nach Gemeinschaft zu suchen, die andere eine ausdrücklich oder stillschweigend vereinbarte, die Art ihres Zusammenlebens in Gemeinschaft betreffende Ordnung. Letztere ist das, was wir das Recht eines Staats nennen, die wahre Seele eines politischen Körpers, dessen Teile durch das Recht mit Leben erfüllt, zusammengehalten und für solche Handlungen in Aktion gesetzt werden, die das gemeinsame Wohl erfordert. Politische, für die äußerliche Ordnung und Regierung von Menschen erlassene Gesetze, werden nie so gestaltet, wie sie sollten. Es sei denn der Wille des Menschen wird als innerlich widerspenstig, aufsässig und jedem Gehorsam gegen die heiligen Gesetze seiner Natur abgeneigt, vorausgesetzt.
In einem Wort: Sie müssen der Annahme gemäß, der Mensch sei in seinem verdorbenen Sinn wenig besser als ein wildes Tier, entsprechend Versorge treffen, seine äußerlichen Handlungen so zu regeln und zu richten, dass sie kein Hindernis für das allgemeine Wohl
werden wegen dem Gesellschaften überhaupt erst gegründet werden. Wenn sie dies nicht gewähren, sind sie nicht vollkommen.
