John Locke: Two Treatises of Government

§ 232. Whosoever uses force without right, as everyone does in society, who does it without law, puts himself into a state of war with those against whom he so uses it; and in that state all former ties are cancelled, all other rights cease and everyone has a right to defend himself and to resist the aggressor. This is so evident, that Barclay72 himself, that great assertor of the power and sacredness of Kings, is forced to confess: That it is lawful for the people in some cases, to resist their King; and that too in a chapter, wherein he pretends to show, that the divine law shuts up the people from all manner of rebellion. Whereby it is evident even by his own doctrine, that since they may in some cases resist all resisting of Princes is not rebellion. His words are these:

Quod siquis dicat, Ergone populus tyrannicae, crudelitati et furori jugulum semper praehibit? Ergone multitudo civitates suas fame, ferro et flamma vastari, seque, conjuges et liberos fortunae ludibrio et tyranni libidine exponi, inque omnia vitae pericula omnesque miserias et molestias a rege deduci patientur? Num illis
quod omni animantium generi est a natura tributum, denegari debet, ut sc. vim vi repellant, seseque; ab injuria tueantur? Huic breviter responsum sit, Populo universo negari defensionem, quae juris naturalis est, neque ultionem quae praeter naturam est adversus regem concedi debere. Quapropter si rex non in
singulares tantum personas aliquot privatum odium exerceat, sed corpus etiam respublicae, cujus ipse caput est, i. e. totum populum, vel insignem aliquam ejus partem immani et intoleranda saevitia seu tyrannide devexet; populo quidem hoc casu resistendi ac tuendi se ab injuria potestas competit; sed tuendi se tantum, non enim in principem invadendi: et restituendae injuriae illatae, non recedendi a debita reverentia propter acceptam injuriam.

Praesentem denique impetum propulsandi non vim praeteritam ulciscendi jus habet. Horum enim alterum a natura est, ut vitam scilicet corpusque tuearmur. Alterum vero contra naturam, ut inferior de superiori supplicium sumat. Quod itaque populous malum, antequam factum sit, impedire potest, ne fiat, id postquam factum est, in regem authorem sceleris vindicare non potest: populus igitur hoc amplius quam privatus quisquam habet: quod huic vel ipsis adversariis judicibus, excepto Buchanano, nullum nisi in patientia remedium superest. Cum ille si intolerabilis tyrannus est (modicum enim ferre omnino debet) resistere cum reverentia possit.

§ 232. Wer physische Gewalt unrechtmäßig anwendet, wie es in der Gesellschaft jeder tut, der sie ohne gesetzliche Grundlage einsetzt, versetzt sich in einen Kriegszustand mit denen, gegen die er sie gebraucht. In dieser Lage werden alle früheren Bande gelöst, hören alle anderen Rechte auf und jeder Einzelne hat das Recht sich zu verteidigen und sich dem Angreifer zu widersetzen.

Dass ist derart evident, dass selbst Barclay72, der große Verfechter von Macht und der Heiligkeit der Könige sich genötigt sieht, einzugestehen: In manchen Fällen ist es der Bevölkerung erlaubt, einem König Widerstand entgegen zu setzen. Das geschieht sogar in einem Kapitel, in dem er nachzuweisen versucht, das göttliche Gesetz verbiete der Bevölkerung jegliche Rebellion. Daraus geht klar hervor, selbst nach seiner eigenen Lehre: Die Bevölkerung darf in manchen Fällen Widerstand leisten und nicht jeder Widerstand gegen Fürsten ist Rebellion. Seine Worte sind folgende:

§ 61. For had our author set down this command without garbling, as God gave it, and joined mother to father, every reader would have seen, that it had made directly against him; and that it was so far from establishing the monarchical power of the father, that it set up the mother equal with him, and enjoined nothing but what was due in common, to both father and mother:

For that is the constant tenor of the scripture, Honor thy father and thy mother, Exod. XX. He that smiteth his father or mother, shall surely he put to death, XXI. 15. He that curseth his father or mother, shall surely be put to death, ver. 17. Repeated, Lev.XX.9. and by our Saviour, Matth. XV.4.

Ye shall fear every man his mother and his father, Lev. XIX.3. If a man have a rebellious son, which will not obey the voice of his father, or the voice of his mother; then shall his father and his mother lay hold on him, and say, This our son is stubborn and rebellious, he will not obey our voice, Deut. XXI.18, 19, 20, 21. Cursed be he that setteth light by his father or his mother, XXVIII.16. My son, hear the instructions of thy father, and forsake not the law of thy mother, are the words of Solomon, a King who was not of what belonged to him as a father or a king; and yet he joins father and mother together, in all the instruction he gives children quite through his book of Proverbs.

Woe unto him that sayeth unto his father. What begettest thou? Or to the woman, what hast thou brought forth? Isa.XI.ver.10. In thee hare they set light by father or mother, Ezek.XXVIII.2. And it shall come to pass, that when any shall yet prophesy, then his father and his mother that begat him, shall say unto him, thou shall not live; and his father and his mother that begat him, shall thrust him through when he prophesied, Zech. XIII.3.

Here not the father only, but the father and mother jointly, had power in this case of life and death. Thus ran the law of the Old Testament, and in the New they are likewise joined, in the obedience of their children, Eph. VI.1. The rule is, children, obey your parents; and I do not remember, that I anywhere read, children, obey your father, and no more:

The scripture joins mother too in that homage, which is due from children; and had there been any text, where the honor or obedience of children had been directed to the father alone, it is not likely that our author, who pretends to build all upon scripture, would have omitted it: Nay, the scripture makes the authority of father and mother, in respect of those they have begot, so equal, that in some places it neglects even the priority of order, which is thought due to the father, and the mother is put first, as Lev.XIX.3 from which so constantly joining father and mother together, as is found quite through the scripture, we may conclude that the honor they have a title to from their children, is one common right belonging so equally to them both, that neither can claim it wholly, neither can be excluded.

§ 61. Hätte unser Autor dieses Gebot wie Gott es erlassen hat, unzensiert eingebracht, „Mutter“ mit „Vater“ vereinigt, hätte jeder Leser erkannt: Es widerlegt ihn unmittelbar und ist weit davon entfernt den Vater in „königliche Macht“ zu versetzen.

Im Gegenteil. Es stellt die Mutter diesem gleich und enthält keine andere Verpflichtung, als was man Vater und Mutter gemeinsam schuldig wäre. Überall aus der Schrift schallt uns der Ton entgegen: „Du sollst deinen Vater und deine Mutter ehren“, Exodus XX.12. „Wer seinen Vater oder Mutter schlägt, der soll des Todes sterben“, Exodus XXI.15. „Wer Vater oder Mutter verflucht, der soll des Todes sterben“, Exodus XXI.17., Lev. XX.9, Matt XV.4. „Jeder fürchte seine Mutter und seinen Vater“, Lev. XIX.3.

„Hat jemand einen eigenwilligen und ungehorsamen Sohn, der Vaters oder Mutters Stimme nicht gehorcht und auch, wenn sie ihn züchtigen, nicht gehorchen will:

So sollen ihn Vater und Mutter ergreifen, zu den Ältesten der Stadt führen, an das Tor desselben Orts und zu den Ältesten der Stadt berichten: Dieser unser Sohn ist eigenwillig und ungehorsam. Er gehorcht unserer Stimme nicht“, Deut. XXI.18-20. „Verflucht sei, wer seinem Vater oder Mutter fluchet“ (Deuteronomium XXVII.16). „Mein Kind gehorche der Zucht deines Vaters und verlasse nicht das Gebot deiner Mutter“, Spr. 1.8, sind die Worte Salomons, ein König der genau wusste, was ihm als Vater und König zukam.

Trotzdem stellt er Vater und Mutter in den Weisungen, die er das ganze Buch der Sprüche den Kindern gibt, nebeneinander: „Wehe dem, der dem Vater klagt: Warum hast du mich gezeugt? Und zur Mutter Weibe: Wozu hast Du mich geboren!“Jes XLV.10. „Vater und Mutter verachten sie“, Ezek. XXII.7. „Wenn jemand jemals weissagt, sollen Vater und Mutter, die ihn gezeugt haben, zu ihm sagen: Du sollst nicht leben, denn du redest falsch im Namen des Herrn.

Deshalb werden also Vater und Mutter, die ihn gezeugt haben, ihn erstechen, wenn er weissagt“, Zech XII.3.

Hier hat nicht der Vater allein, sondern Vater und Mutter haben gemeinschaftlich Macht über Leben und Tod. So lautet das Gesetz des Alten Testaments. Im Neuen Testament werden sie im Gehorsam der Kinder ebenso vereinigt, Eph. VI.1. „Kinder, seid gehorsam euren Eltern“, lautet die Vorschrift. Allerdings erinnere ich mich nicht, irgendwo gelesen zu haben: „Kinder, seid gehorsam eurem Vater“, und nichts weiter.

Die Schrift verbindet Vater und Mutter in der Ehrerbietung, die die Kinder schuldig sind. Hätte es je einen Text gegeben, indem Ehre und Gehorsams der Kinder allein dem Vater zugestanden wurden, hätte unser Autor, der alles auf die Bibel zu gründen vorgibt, ihn wahrscheinlich nicht übersehen.

Nein, die Heilige Schrift stellt „Vater und Mutter“ in der Autorität denen, die sie gezeugt haben, so eindeutig gleich, dass sie an einigen Stellen sogar die Rangfolge, in der dem Vater der Vorzug gebührend unterstellt wird, außer Acht lässt und die Mutter (Lev. XIX.3) an die erste Stelle setzt.

Vater und Mutter werden beständig nebeneinander gestellt, wie es in der ganzen der Fall ist. Daraus dürfen wir schließen, es sei eine gemeinschaftliche Ehre, auf die sie seitens der Kinder Anspruch haben, ein ihnen so gleichmäßig gehörendes Recht ist, das keiner von beiden es weder ganz in Anspruch nehmen
noch davon ausgeschlossen werden kann.
