John Locke: Two Treatises of Government

§ 192. By the second, the inhabitants of any country, who are descended, and derive a title to their estates from those who are subdued, and had a government forced upon them against their free consent, retain a right to the possession of their ancestors, though they
consent not freely to the government, whose hard conditions were by force imposed on the possessors of that country: For the first conqueror never having had a title to the land of that country, the people who are the descendents of, or claim under those who were forced to submit to the yoke of a government by constraint, have always a right to shake it off, and free themselves from the usurpation or tyranny which the sword hath brought in upon them, till their rulers put them under such a frame of government, as they willingly and of choice consent to.

Who doubts but the Grecian Christians, descendents of the ancient possessors of that country, may justly cast off the Turkish yoke, which they have so long groaned under, whenever they have an opportunity to do it? For no government can have a right to obedience from a people who have not freely consented to it; which they can never be supposed to do, till either they are put in a full state of liberty to choose their government and governors, or at least till they have such standing laws, to which they have by themselves or their representatives given their free consent, and also till they are allowed their due property, which is so to be proprietors of what they have, that nobody can take away any part of it without their own consent, without which, men under any government are not in the state of freemen, but are direct slaves under the force of war.

§ 192. Durch das zweite behalten nachfolgende Bewohner eines Landes, deren Ahnen eine Regierung gegen ihr freies Einvernehmen aufgezwungen wurde, und die von diesen auch Anspruch auf Landbesitz herleiten, das Recht auf diesen Besitz ihrer Vorfahren. Vor allem, wenn sie der Regierung nicht frei zustimmen, deren harte Bedingungen den Besitzern des Landes mit Gewalt auferlegt wurden. Da der erste Eroberer nie Anspruch auf Grund und Boden des Landes haben konnte, hat das Volk, das seine Abstammung oder sonstige Ansprüche von jenen herleitet, die sich dem Joch einer gewaltsam aufgezwungenen Regierung beugen mussten, immer ein Recht es abzuschütteln.
Sie dürfen sich von Usurpation und Tyrannei, die das Schwert über die Ahnen gebracht hatte, befreien, bis ihre Anführer ihnen eine Regierungsform aufstellen, der sie willig und aus freier Wahl zustimmen.

Wer bezweifelt, dass die Griechischen Christen, Nachkommen der alten Besitzer jenes Landes, mit vollem Recht das türkische Joch, unter dem sie schon lange stöhnen, abwerfen dürfen, sobald sie Gelegenheit dazu finden? Keine Regierung kann ein Recht auf Gehorsam von Seiten einer Bevölkerung haben, die ihr nicht frei zugestimmt hat.

Man darf keinesfalls annehmen, es stimme jemals zu, solange sie weder den Zustand völliger Freiheit erreichen, ihre Regierung und Regenten zu wählen, noch solange sie nicht mindestens stehende Gesetze haben, denen sie selbst oder durch Vertreter seine freie Einvernehmen gegeben haben. Gleiches gilt, bis ihnen ihr fälliges Eigentum zuerkannt wird, das darin besteht, in der Weise Eigentümer ihres Besitzes zu sein, dass niemand ohne ihre Einvernehmen einen Teil davon nehmen darf. Ohne das haben Menschen unter keiner Regierung den Status freier Menschen, sondern sind geradezu Sklaven unter der rohen Gewalt des Kriegs.

§ 33. For it is plain, however he would exclude them, that part of this benediction, as he would have it in succession, must needs be meant to the sons, and not to Noah himself at all: Be fruitful, and multiply, and replenish the earth, says God, in this blessing. This part of the benediction, as appears by the sequel, concerned not Noah himself at all: For we read not of any children he had after the flood; and in the following chapter, where his posterity is reckoned up, there is no mention of any; and so this benediction in succession was not
to take place till 350 years after:

And to save our author’s imaginary monarchy, the peopling of the world must be deferred 350 years; for this part of the benediction cannot be understood with subordination, unless our author will say, that they must ask leave of their father Noah to lie with their wives. But in this one point our author is constant to himself in all his discourses, he takes great care there should be monarchs in the world, but very little that there should be people; and indeed his way of government is not the way to people the world:

For how much absolute monarchy helps to fulfill this great and primary blessing of God Almighty: Be fruitful, and multiply, and replenish the earth, which contains in it the improvement too of arts and sciences, and the conveniences of life, may be seen in those large and rich countries which are happy under the Turkish government, where are not now to be found one third, nay, in many, if not most parts of them one thirtieth, perhaps I might say not one hundredth of the people, that were formerly, as will easily appear to anyone, who will compare the accounts we have of it at this time, with ancient history. But this by the by.

§ 33. So gern er die Söhne ausschließen möchte, es ist klar: Ein Teil des Segens, den er „auf Erbfolge“ verstanden sehen will, muss zwangsläufig auf die Söhne bezogen werden und eben nicht auf Noah selbst. „Seid fruchtbar und mehret euch und erfüllet die Erde“, sagt Gott in seinem Segen. Dieser Teil des Segens betraf, wie sich gleich zeigt, Noah überhaupt nicht. Wir lesen nichts von Kindern, die er nach der Flut gehabt haben sollte, noch werden im folgenden Kapitel, wo die Nachkommenschaft aufgezählt wird, Kinder Noahs erwähnt.

Der Segen „auf Erbfolge“ hätte also erst 350 Jahre später in Erfüllung gehen können. Das Wiederbevölkern der Erde also um 350 Jahre verschoben werden müssen, um unserem Autor die eingebildete Monarchie zu retten. Dieser Teil des Segens kann wohl kaum „mit Unterordnung“ verstanden werden, es sei denn unser Autor wollte behaupten, sie hätten ihren Vater Noah um Erlaubnis bitten müssen, um mit ihren Frauen zu schlafen.

In allen seinen Abhandlungen bleibt sich unser Autor in einem Punkt treu: Er ist sehr sorgsam darauf bedacht, dass es Monarchen in der Welt gibt. Ob es auch Völker gibt kümmert ihn sehr wenig. Seine Art der Regierung ist tatsächlich kein Weg, die Welt zu bevölkern. Wie sehr die absolute Monarchie beiträgt, diesen ersten und größten Segen Gottes des Allmächtigen „Seid fruchtbar und mehret euch und erfüllet die Erde“ zu verwirklichen, was auch den Fortschritt an Fertigkeiten, Fähigkeiten und Annehmlichkeiten des Lebens beinhaltet, kann man in jenen großen und reichen Ländern sehen, die das Gluck haben, unter türkischer Herrschaft zu stehen. Dort ist jetzt kaum ein Drittel, nein, in vielen, wenn nicht gar den meisten, kaum ein Dreißigstel, ich kann unter Umständen behaupten kein Hundertstel der ehemaligen Bevölkerung mehr vorhanden. Jeder kann sich leicht davon überzeugen, der unsere heutigen Berichte mit denen der älteren Geschichte vergleicht. Dies aber nur nebenbei.
