John Locke: Two Treatises of Government

§ 153. It is not necessary, no, nor so much as convenient, that the legislative should be always in being; but absolutely necessary that the executive power should, because there is not always need of new laws to be made, but always need of execution of the laws that are made. When the legislative hath put the execution of the laws, they make, into other hands. They have a power still to resume it out of those hands, when they find cause, and to punish for any mal-administration against the laws.

The same holds also in regard of the federative power, that and the executive being both ministerial and subordinate to the legislative, which, as has been showed, in a constituted commonwealth is the supreme. The legislative also in this case being supposed to consist of several persons, (for if it be a single person, it cannot but be always in being, and so will, as supreme, naturally have the supreme executive power, together with the legislative) may assemble, and exercise their legislature, at the times that either their original constitution, or their own adjournment, appoints, or when they please; if neither of these hath appointed any time, or there be no other way prescribed to convoke them:

For the supreme power being placed in them by the people, it is always in them, and they may exercise it when they please, unless by their original constitution, they are limited to certain seasons, or by an act of their supreme power they have adjourned to a certain time; and when that time comes, they have a right to assemble and act again.

§ 153. Es ist weder notwendig, nein, noch nicht einmal passend, dass die Legislative dauernd besteht. Absolut notwendig ist dies dagegen bei der Exekutive. Der Bedarf an neuen Gesetzen ist nicht ständig vorhanden, wohl aber Bedarf des Vollzugs gegebener Gesetze.

Sollte die Legislative den Vollzug ihrer erlassenen Gesetze in andere Hände gelegt haben, behält sie noch immer die Macht, sie diesen Händen zu entziehen falls sie Anlass dazu hat und jede schlechte, gesetzeswidrige Verwaltung zu bestrafen. Gleiches gilt die föderative
Macht betreffend, denn beide, die föderative und die exekutive Macht stehen im Dienst der Legislative und sind dieser untergeordnet, da jene, wie nachgewiesen worden ist, in einem Verfassungsstaat die höchste ist.

Die Legislative, auch in diesem Fall als aus mehreren Personen bestehend angenommen, (denn läge sie bei einer einzigen Person, wäre sie eine permanente und hätte als oberste natürlich auch die höchste exekutive Macht zusammen mit der legislativen), kann sich zu jeder Zeit versammeln und ihre Legislative ausüben, die ihre ursprüngliche Satzung, ihr eigener Beschluss zur nächsten Zusammenkunft es zulassen. Falls durch keines von beiden Ort und Zeit festlegt oder kein anderer Weg zu ihrer Berufung vorgeschrieben ist: Wann sie will. Denn da ihr vom Volk höchste Macht gewährt wurde, liegt diese stets bei ihr und sie darf sie ausüben, wann sie will, falls sie nicht original durch Verfassung an bestimmte Perioden gebunden wurde oder durch Beschluss mittels ihrer höchsten Macht sich bis zu einer bestimmten Zeit vertagt hat. Wenn diese Zeit da ist, hat sie das Recht sich zu versammeln und erneut zur Tat zu schreiten.
