§ 30. Thus this law of reason makes the deer that Indian’s who hath killed it; it is allowed to be his goods, who hath bestowed his labour upon it, though before it was the common right of everyone. And amongst those who are counted the civilized part of mankind, who have made and multiplied positive laws to determine property, this original law of nature, for the beginning of property, in what was before common, still takes place; and by virtue thereof, what fish anyone catches in the ocean, that great and still remaining common of mankind; or what ambergrease35 anyone takes up here, is by the labour that removes it out of that common state nature left it in, made his property, who takes that pains about it. And even amongst us, the hare that anyone is hunting, is thought his who pursues her during the chase: For being a beast that is still looked upon as common, and no mans private possession; whoever has employed so much labor about any of that kind, as to find and pursue her, has thereby removed her from the state of nature, wherein she was common, and hath begun a property.

§ 30. Das Gesetz der Vernunft gewährt das Wild dem Indianer zum Besitz, der es getötet hat. Obwohl es zuvor Gemeinbesitz war, erkennt man an, dass es sich um dessen privaten Besitz handelt, der Arbeit darauf verwandt hat. Unter denen, die zu dem zivilisierten Teil der Menschheit gerechnet werden, und die zur Bestimmung von Besitz eine Vielzahl positiver Gesetze in geschaffen haben, behauptet dieses ursprüngliche Naturgesetz für den Anfang privaten Besitzes an dem, was vorher noch Gemeinbesitz war, noch heute seinen Platz. Und kraft dieses Gesetzes wird der Fisch, den jemand im Ozean, diesem großen und andauernden Gemeinbesitz der Menschheit, fängt, und das Ambra35, das dort jemand herausholt, durch die Arbeit, die ihn aus jenem Zustand des Gemeinbesitzes, in dem die Natur ihn gelassen hat, herausnimmt, zum Besitz dessen, der sich dieser Mühe unterzieht. Und selbst bei uns wird der Hase, den jemand jagt, für den Besitz desjenigen gehalten, der ihn während der Jagd verfolgt. Er ist ein Tier, zunächst als Gemeinbesitz und als keines Menschen Privatbesitz betrachtet. Auf diese Art hat derjenige, der so viel Mühe auf einen Hasen verwandt hat, ihn aufzuspüren und zu jagen, ihn dadurch aus dem Naturzustand entfernt, in welchem er noch Besitz aller war und den Besitz an ihm angetreten.
